Legal Agreement and Binding Nature
These Terms and Conditions constitute a legally binding agreement between you and DataFlow Academy. By accessing our website, enrolling in courses, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
This agreement governs your relationship with DataFlow Academy and establishes the legal framework for your use of our educational services, intellectual property, and digital platforms. Violation of these terms may result in legal action and termination of services.
User Obligations and Responsibilities

1. Compliance Requirements:

- • Respect Sri Lankan educational regulations and standards
- • Adhere to data protection and privacy laws
- • Follow intellectual property and copyright regulations
2. Academic Integrity:
- • Submit original work and properly cite all sources
- • Avoid plagiarism, cheating, and academic misconduct
- • Maintain honesty in all academic and professional interactions
- • Respect the academic standards of our institution
3. Professional Conduct:
- • Maintain respectful communication with peers and instructors
- • Protect confidential information shared during courses
- • Use learning resources responsibly and ethically
- • Report violations or misconduct promptly
Prohibited Activities
1. Illegal Conduct:
- • Any activity that violates Sri Lankan or international law
- • Fraud, misrepresentation, or identity theft
- • Harassment, discrimination, or hate speech
- • Unauthorized access to computer systems or data
2. Platform Misuse:
- • Attempting to circumvent security measures
- • Distributing malware, viruses, or harmful code
- • Overloading or disrupting our technical infrastructure
- • Creating multiple accounts to violate policies
3. Content Violations:
- • Sharing inappropriate, offensive, or illegal content
- • Infringing on intellectual property rights
- • Posting false or misleading information
- • Commercial solicitation without authorization
Liability Limitations and Warranty Disclaimers
Disclaimer of Warranties
1. Educational Services "AS IS"
Our courses and services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee specific learning outcomes, job placement, or career advancement results.
2. No Employment Guarantees
While we provide career support and job placement assistance, we cannot guarantee employment outcomes. Job placement success depends on individual performance, market conditions, and employer requirements.
3. Technical Limitations
We disclaim warranties regarding uninterrupted service availability, error-free content delivery, or compatibility with all devices and software configurations.
Limitation of Liability
1. Maximum Liability Cap
Our total liability for any claims arising from these terms shall not exceed the amount you paid for the specific service that gave rise to the claim, limited to the past 12 months.
2. Excluded Damages
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.
3. Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical infrastructure failures.
Indemnification Obligations
User Indemnification Commitment
You agree to indemnify, defend, and hold harmless DataFlow Academy, its directors, officers, employees, and agents from and against any and all claims, damages, costs, and expenses (including reasonable attorney fees) arising from:
- • Your violation of these Terms and Conditions or any applicable law
- • Your misuse of our services, content, or intellectual property
- • Your interactions with other users or third parties
- • Any content you submit, post, or transmit through our platforms
- • Claims that your use of our services infringes third-party rights
Defense and Settlement Rights
DataFlow Academy reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims. You may not settle any claim without our prior written consent.
Legal Information and Dispute Resolution
Governing Law and Jurisdiction
1. Applicable Law:
These Terms and Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflict of law principles.
2. Jurisdiction:
Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Colombo, Sri Lanka. Both parties consent to personal jurisdiction in these courts.
3. International Users:
Users accessing our services from outside Sri Lanka do so at their own risk and are responsible for compliance with local laws in their jurisdiction.
Dispute Resolution Process
1. Informal Resolution:
Before initiating formal proceedings, parties must attempt to resolve disputes through good faith negotiations for at least 30 days.
2. Mediation:
If informal resolution fails, disputes may be submitted to mediation through a mutually agreed mediator in Colombo, Sri Lanka.
3. Legal Action:
Any legal action must be commenced within one year after the cause of action arises, or such claim shall be permanently barred.
Severability and Terms Modification
Severability Clause
If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary.
The remainder of these terms shall remain in full force and effect, and the unenforceable provision shall be deemed modified to reflect the parties' intention as closely as possible.
Terms Modification Policy
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website with an updated "Last Modified" date.
Continued use of our services after modifications constitutes acceptance of the revised terms. We encourage regular review of these terms.
